Terms of Service

Softpixel runs this website. When we say "we," "us," or "our" throughout the site, that's us. We're offering you everything on this site—all the information, tools, and services—but only if you agree to the terms, conditions, policies, and notices we've laid out here. By using our site or hiring us for services, you're engaging in what we call our "Service," and you're agreeing to follow the terms and conditions below. That includes any additional terms and conditions or policies mentioned here or linked from this page. These terms apply to everyone who uses the site, whether you're just browsing, working with us as an agency, a client, a designer, or contributing content. Take a moment to read through these Terms of Service before you start using our website. If you access or use any part of this site, you're bound by what's written here. Don't use the site or our services if you can't agree to all of this. If we're making an offer, your acceptance is limited strictly to these terms. Any new features or tools we add to our service fall under these same terms. You can check the latest version of the Terms of Service here anytime. We can update, change, or replace parts of these terms whenever we want by posting changes on the site. It's on you to check back once in a while to see what's changed. Keep using the site after we post updates, and you're saying you accept them.

SECTION 1 - ONLINE SERVICES TERMS

By accepting these terms, you're telling us you're at least 18 (or the age of majority where you live), or that you have the legal right to let any minors in your care use the site. Don't use our services for anything illegal or unauthorized. When you use the service, you can't break any laws in your area—including copyright laws. Don't send us worms, viruses, or any destructive code. If you break these terms or violate them, your access to the services stops immediately.

SECTION 2 - GENERAL CONDITIONS

We can refuse service to anyone, anytime, for any reason. Your content (not including payment info) might travel unencrypted across different networks and may need to be changed to work with various systems and devices. Payment information always gets encrypted when it travels over networks. You can't reproduce, duplicate, copy, sell, resell, or exploit any part of the service or access to it. That includes any contact information on the site without our explicit written permission. The headings in this agreement are just for convenience and don't actually limit or change what these terms say.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We're not responsible if information on this site isn't accurate, complete, or up to date. The material here is general information only and shouldn't be your only source when making decisions. Look for primary, more accurate, more complete, or more current information elsewhere. Using what's on this site is at your own risk. The site may have some historical information on it. By definition, that's not current—it's there for reference. We can modify what's on this site whenever we want, but we don't have to update anything. You're responsible for keeping track of what changes on our site.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICING

Our service prices can change without warning. We can modify or stop the service (or parts of it) anytime without telling you first. We're not liable if we change prices, pause, or discontinue the service.

SECTION 5 - SERVICES (if applicable)

Some services are only available through the website. They have limited availability and can only be delivered or changed according to our Project Agreement. We try hard to show the work samples and portfolio images from our design services as accurately as we can. We can't guarantee that what you see on your monitor is the true color though. We can limit our services to certain people, places, or areas if we want to, handling it case by case. We can also limit how many projects we take on. Service descriptions and pricing can change anytime without notice, at our discretion. We can turn down any project at any time. Any service offer on this site is void where it's not allowed by law. We don't promise that services or information we give you will match what you're hoping for, or that we'll fix every problem in the service.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We can refuse any project you want to start with us. We might limit or change the scope of work based on what we think is best. That decision could come down to your account info, payment method, or project details. If we need to change or cancel something, we'll try to reach you using the email or phone number you gave us when you started. We also reserve the right to decline projects that don't fit with what we offer or what we're capable of doing. You need to give us current, complete, and accurate contact and account information for every service. Keep your account updated, including your email and payment details, so we can stay in touch and send invoices. Check out our Project Agreement for more information.

SECTION 7 - OPTIONAL TOOLS

We might give you access to third-party tools that we don't monitor, control, or have any say in. You understand that we're providing access to these tools "as is" and "as available" without warranties or guarantees of any kind. We're not responsible for anything that comes from using these optional tools. Using optional tools through the site is completely your choice, and it's your risk. Make sure you understand and approve of the terms from whoever provides the tool. Down the road, we might offer new services or features through the site, including new tools and resources. Those will also be covered by these terms.

SECTION 8 - THIRD-PARTY LINKS

Some of what you can access through our service includes material from other companies. Third-party links on this site might take you to websites that aren't connected to us. We're not responsible for checking or evaluating what's on those sites, and we don't promise anything about third-party material, websites, or services. We're not liable for any harm or damage from third-party stuff. We're not responsible for harm from buying or using goods, services, or anything else from third-party websites. Look carefully at their policies before you do business with them. If you have a problem with a third-party product, contact them directly.

SECTION 9 - USER FEEDBACK AND OTHER SUBMISSIONS

If we ask you to send something specific (like project feedback) or you send us ideas, suggestions, proposals, plans, or other material on your own—whether online, by email, by mail, or any other way (we'll call it "feedback")—you agree we can use it. We can edit, copy, publish, share, translate, and use your feedback however we want and in any form. We don't have to keep it private, pay you for it, or even respond to it. We might monitor, edit, or remove content that we think is unlawful, offensive, threatening, defamatory, pornographic, or otherwise objectionable. Same goes for anything that violates someone's intellectual property rights or these terms. Your feedback shouldn't violate anyone's rights, including copyright, trademark, privacy, or personal property rights. It also can't contain anything libelous, unlawful, abusive, obscene, or contain viruses or malware that could mess with the service or any related website. Don't use a fake email, pretend to be someone else, or mislead us about where the feedback came from. You're responsible for what you send and whether it's accurate. We don't take responsibility for feedback from you or anyone else.

SECTION 10 - PERSONAL INFORMATION

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

Sometimes the site or service has typos, mistakes, or missing information about service descriptions, pricing, promotions, offers, timelines, and availability. We can fix errors anytime and change or remove information without telling you first, even after you've submitted a request. We might cancel projects if something isn't right. We don't have to update, fix, or clarify anything in the service or on any related site, unless the law says we have to. Don't assume that just because there's a "last updated" date, everything has actually been changed or refreshed.

SECTION 12 - PROHIBITED USES

Beyond what's already in these terms, you can't use the site or its content for anything illegal, to get others to break the law, or to violate any regulations or local laws. You can't infringe on our intellectual property or anyone else's. You can't harass, abuse, insult, harm, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability. Don't submit false information, upload viruses or malicious code, collect others' personal data, spam, phish, scrape, or try to hack the service or related websites. We can stop your access if you break these rules.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We don't guarantee the service will be uninterrupted, timely, secure, or error-free. We can't promise that what you get from using the service will be accurate or reliable. You agree that we can remove or cancel the service whenever we want, with no notice. You're using the service at your own risk. Everything we provide through the service is given "as is" and "as available" without any promises, warranties, or conditions—whether expressed or implied. That includes all implied warranties about being fit for sale, working properly, or meeting your needs. We're not liable for injury, loss, claims, or any direct, indirect, incidental, punitive, special, or consequential damages. That covers lost profits, lost revenue, lost savings, lost data, replacement costs, and similar damages, whether from contract, negligence, strict liability, or anything else. This applies even if we knew something like this could happen. It covers harm from using the service, buying anything through it, or any errors, omissions, or content on the site. Some places don't allow limits on liability, so our liability there is limited as much as the law allows.

SECTION 14 - INDEMNIFICATION

You agree to protect and hold Softpixel, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns, and employees harmless from any claim or demand, including attorney's fees, from a third party because you broke these terms or any laws, or violated someone's rights.

SECTION 15 - SEVERABILITY

If any part of these terms is ruled unlawful or unenforceable, that part stays enforceable as much as the law allows. The rest of the terms keep working.

SECTION 16 - TERMINATION

What both of us owe each other before termination stays in effect after. These terms are active unless either you or we end them. You can stop using our services anytime by telling us you don't want them anymore or just by stopping use. If we think you're not following these terms, we can end the agreement anytime without notice. You still owe us everything up to that date, and we can cut off your access.

SECTION 17 - ENTIRE AGREEMENT

If we don't enforce a right or rule in these terms, that doesn't mean we've given it up. These terms, plus any policies or rules we post on the site, make up the whole agreement between us. They control how you use the service and replace anything we've said before—whether spoken or written, including earlier versions of these terms. We're not going to twist the language of these terms against you.

SECTION 18 - GOVERNING LAW

These terms are governed by the laws of Nova Scotia, Canada.

SECTION 19 - CHANGES TO TERMS OF SERVICE

You can see the current version of the terms anytime on this page. We can update, change, or replace parts of these terms whenever we want by posting changes on the site. Check back periodically to see what's new. If you keep using the site or service after we post changes, you're accepting them.
